  1. General Provisions

  2. These Terms and Conditions govern the use of the Ślubny Organizer mobile application, including access to free features and the purchase and use of full Premium access.

  3. The owner and provider of the App is Robert Kostrzewa, trading as KOSTRZEWADESIGN.COM, address: ul. Stefana Okrzei 109, 55-080 Kąty Wrocławskie, Poland, Tax Identification Number (NIP): 8961456432, email: [email protected], hereinafter referred to as the “Service Provider.”

  4. The App is available for Android devices through Google Play and for iOS devices through the App Store. Depending on the language and region, it may be listed under a localized name.

  5. The App is intended for people planning a wedding ceremony and reception. No account within the App is required to use it.

  6. These Terms and Conditions are provided free of charge in a format that allows them to be saved and reproduced.

  7. The User agrees to use the App in accordance with these Terms and Conditions and applicable law.

  8. Definitions

  9. App means the Ślubny Organizer mobile application available on Google Play and the App Store, including under its localized names.

  10. User means a person using the App.

  11. Service Provider means Robert Kostrzewa, conducting business under the business name specified in Section 1.2.

  12. Store means Google Play for Android or the App Store for iOS, as applicable.

  13. Premium means access to the App’s paid features for an indefinite period on a particular platform, acquired through a one-time in-app purchase.

  14. User Content means information entered into the App, such as tasks, expenses, guest details, names, dietary information, accommodation, transportation and seating arrangements.

  15. Backup means a copy of the App’s data saved on the User’s device using the backup feature available in the App.

  16. App Features

  17. The App helps Users organize a wedding ceremony and reception. Its features may include, in particular:

    • setting up basic wedding information;

    • lists of predefined and custom tasks;

    • budget planning and tracking expenses and payments;

    • a guest list and guest-related planning information;

    • creating tables and assigning guests to them;

    • viewing planning progress and a countdown to the wedding date;

    • creating and restoring a local data backup.

  18. The App is a planning tool. It does not provide legal, financial, accounting or wedding planning services.

  19. The App’s features and appearance may be developed or updated. Information about currently available features is provided in the App and in its listing in the relevant Store.

  20. The availability of individual features may depend on the App version, operating system and technical capabilities of the device.

  21. Technical Requirements

  22. To use the App, the User needs:

    • an Android or iOS device supported by the current version of the App;

    • access to the relevant Store to download the App and, where applicable, purchase Premium;

    • an internet connection to the extent required to download and update the App and to process, restore and verify a Premium purchase;

    • sufficient free storage space on the device to store data and backups.

  23. Current operating system requirements and device compatibility information are provided in the App’s listing in the relevant Store.

  24. Some features may work without a continuous internet connection. However, a connection may be required to purchase, restore or verify Premium.

  25. The User should install App updates required to maintain conformity with the contract, including security updates, in accordance with the information provided.

  26. Account, Data Storage and Backups

  27. The App does not require registration or login. Downloading the App and purchasing Premium may require a Google Account or Apple Account, in accordance with the relevant Store’s rules.

  28. User Content is stored locally on the User’s device. The App does not provide a user account, storage of this content on the Service Provider’s servers or automatic synchronization between devices.

  29. The Service Provider does not have access to the planning data stored locally by the User.

  30. The App allows Users to create a data backup on their phone and restore data from that backup to the extent supported by its features.

  31. Creating a backup on the same device does not protect data against loss, damage or theft of the device. The availability of a backup after uninstalling the App or clearing its data depends on where the backup is saved and how the operating system works.

  32. A backup of User Content does not transfer Premium access between Google Play and the App Store and does not replace restoring the purchase through the relevant Store.

  33. Data relating to a Premium purchase may be processed by the relevant Store operator and RevenueCat to process, confirm, verify and restore the purchase.

  34. The User should protect their device and backups against unauthorized access.

  35. Uninstalling the App, clearing its data or device failure may result in the loss of locally stored User Content. Data can only be restored if a valid backup supported by the App is available. The Service Provider does not hold a server-side copy of this content.

  36. Detailed information about data and its processing is available in the Privacy Policy:
    https://slubnyorganizer.pl/polityka-prywatnosci

  37. Free Plan

  38. The App may be used free of charge within the usage limits displayed in the App.

  39. The following free plan limits apply on both platforms:

    • up to 30 completed tasks;

    • up to 20 added guests;

    • up to 30 budget items marked as paid.

  40. These limits apply to feature usage, rather than the duration of the free plan. The free plan is not a trial period that automatically converts into a paid service.

  41. The way usage is counted towards these limits is shown in the App.

  42. Once a limit is reached, further use of the relevant feature may require a Premium purchase. The User may continue using the other features available under their plan.

  43. Reaching a limit does not itself result in a charge or a purchase.

  44. Purchasing and Using Premium

  45. Premium is a one-time in-app purchase. It is not a subscription, does not renew automatically and does not involve recurring fees.

  46. The standard price of Premium is:

    • PLN 99.00 in Poland;

    • USD 24.99 in the United States.

  47. The price for a particular purchase, currency, any applicable taxes and available promotions are presented in the relevant Store before payment is authorized. The final amount displayed by the Store before the purchase is confirmed is binding. Prices in other countries may vary depending on local conditions and Store settings.

  48. Payments are processed:

    • through Google Play for the Android version;

    • through the App Store for the iOS version.

  49. The payment methods, policies and procedures of the relevant Store apply to payments.

  50. Once the Premium purchase is confirmed, the App unlocks the paid features included in the offer. An internet connection may be required to verify the purchase.

  51. A Premium purchase applies only to the platform on which it was made. A purchase on Google Play does not unlock Premium in the App Store version, and a purchase on the App Store does not unlock Premium in the Google Play version. Using Premium on both platforms requires a separate purchase on each platform.

  52. Premium is linked to the account used to make the purchase in the relevant Store. The purchase may be restored in the App on a supported device on the same platform using the same Store account, provided that the purchase remains valid and is available for verification.

  53. Restoring a Premium purchase does not automatically restore User Content. Data may be restored separately from an available backup.

  54. A Premium purchase does not include future, separate products or services that may be expressly offered as separate purchases.

  55. Premium provides access to the features included in the purchase for an indefinite period, without recurring fees, for as long as the App and those features remain available and can be technically supported. This provision does not limit the User’s statutory rights concerning the conformity of digital content or digital services with the contract.

  56. If the relevant Store refunds, cancels or invalidates the purchase, Premium access may be revoked.

  57. For matters relating to charges, payment confirmation or refunds, the User may use the relevant Store’s procedures. This does not limit any rights the User may have against the Service Provider under applicable law.

  58. Right of Withdrawal and Refunds

  59. For purchases made through Google Play, the User may submit a refund request through Google Play in accordance with that Store’s procedures.

  60. For purchases made through the App Store, the User may submit a refund request through Apple, including at https://reportaproblem.apple.com.

  61. Eligibility for a refund under a Store’s procedures depends on the circumstances of the purchase, the region and the applicable rules. These procedures do not replace or limit statutory consumer rights.

  62. Where applicable law grants a consumer the right to withdraw from a distance contract, the consumer may exercise that right within the statutory period, generally 14 days from the conclusion of the contract, subject to statutory exceptions.

  63. The right to withdraw from a contract for paid digital content not supplied on a tangible medium may be lost once supply begins before the withdrawal period expires only if all legally required conditions have been met. These include, in particular, the consumer’s prior express consent, informing the consumer that they will lose the right of withdrawal, the consumer’s acknowledgment of that information and provision of the required confirmation of the contract.

  64. Acceptance of these Terms and Conditions alone does not replace any separate consent or acknowledgments required for the loss of the right of withdrawal.

  65. If the conditions for the loss of the right of withdrawal have not been met, the User retains the rights granted by applicable law.

  66. To submit a notice of withdrawal, the User may also contact the Service Provider at [email protected]. To help process the request, the User should, where available, provide the purchase date, the relevant Store and the order ID.

  67. Nothing in these Terms and Conditions excludes or limits any consumer rights arising under mandatory provisions of law.

  68. Complaints and Conformity with the Contract

  69. The User may report a problem with the App’s operation, a Premium purchase or access to features by emailing [email protected].

  70. Where possible, the report should include:

    • a description of the problem;

    • the device model and Android or iOS version;

    • the App version;

    • information about when the problem occurred;

    • the Store name and order ID, if the problem concerns a purchase;

    • the requested resolution.

  71. The User should not send Google Account or Apple Account passwords or full payment card details.

  72. The Service Provider will respond to a complaint within 14 days of receiving it, unless applicable law provides a different deadline for the matter concerned.

  73. Consumers are entitled to statutory remedies if the App or Premium does not conform to the contract. These Terms and Conditions do not limit the right to have digital content or digital services brought into conformity with the contract, obtain a price reduction, terminate the contract or exercise other rights where the conditions provided by law are met.

  74. For matters relating solely to payment processing, the User may also contact Google Play or Apple support, depending on where the purchase was made.

  75. Rules for Using the App

  76. The User agrees to use the App lawfully and for its intended purpose.

  77. Actions that disrupt the App’s operation, compromise system security or infringe the rights of third parties are prohibited.

  78. The User should only enter data that they are entitled to use and whose use in the App is lawful. The User should respect guests’ privacy, particularly when recording information about health, allergies or diets, and comply with any information obligations imposed by applicable law.

  79. The App is intended for private planning of the User’s own event. The User may not copy, distribute, sell or make elements of the App available as their own product, unless permitted by law.

  80. When using the App, the User should comply with applicable third-party terms of service, including those of the relevant Store.

  81. Copyright and License

  82. Rights to the App, its name, design, text, graphics and other elements belong to the Service Provider or to parties that have granted the Service Provider the appropriate rights.

  83. The User is granted a non-exclusive, non-transferable right to use the App on devices they own or control, in accordance with the App’s intended purpose, these Terms and Conditions and the relevant Store’s rules.

  84. For the App downloaded from the App Store, the license terms are also governed by the Apple Standard End User License Agreement, available at:
    https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

  85. These Terms and Conditions supplement the Apple Standard End User License Agreement with respect to the provision of services, the free plan and Premium. They do not replace that agreement or limit any rights arising under mandatory provisions of law.

  86. Use of the App on Apple devices is subject to Apple’s usage rules. Sharing through Store features is available only to the extent that the relevant feature is available and covers the App or the particular purchase.

  87. These Terms and Conditions do not transfer any copyright or other intellectual property rights in the App to the User.

  88. The User retains the rights to the content they enter. Saving that content in the App does not transfer those rights to the Service Provider.

  89. Availability and Liability

  90. The Service Provider makes efforts to ensure that the App functions properly but does not guarantee uninterrupted availability on every device and under all conditions. This does not limit the Service Provider’s obligations under laws governing the conformity of digital content or digital services with the contract.

  91. Temporary unavailability may result, in particular, from updates, technical maintenance, failures affecting the device, Android or iOS, Google Play or the App Store, or other circumstances beyond the Service Provider’s control.

  92. Because data is stored locally, loss of the device, uninstalling the App, clearing its data or damage to a backup may make it impossible to recover User Content.

  93. The Service Provider is not liable for the loss of locally stored User Content to the extent that the loss results from circumstances for which the Service Provider is not legally responsible.

  94. The Service Provider is responsible for the App’s operation and support relating to its features, subject to the Store operators’ obligations under their terms and applicable law. Apple’s role is additionally governed by the standard license agreement referred to in Section 11.3.

  95. These Terms and Conditions do not exclude or limit the Service Provider’s liability to the extent that such exclusion or limitation would be unlawful, particularly in relation to consumers.

  96. Changes to These Terms and Conditions

  97. The Service Provider may amend these Terms and Conditions for valid reasons, such as:

    • changes in applicable law;

    • changes to the App’s features or operation;

    • changes to distribution or payment processing rules in the relevant Store;

    • the need to improve security;

    • changes to the Service Provider’s contact or identification details.

  98. The amended Terms and Conditions will be published at https://slubnyorganizer.pl/regulamin together with their effective date.

  99. Changes will not affect rights already acquired by Users, including rights arising from purchased Premium access, or convert a one-time purchase into a subscription.

  100. If a change affects the User’s rights or obligations, the Service Provider will notify the User sufficiently in advance and in the manner required by applicable law, including on a durable medium where required.

  101. Changes to the digital content or digital services supplied will be made only under conditions permitted by applicable law and with respect for the User’s rights.

  102. A User who does not accept the changes may stop using the App. This does not deprive the User of any statutory rights or rights relating to a previously concluded contract.

  103. Governing Law and Contact

  104. These Terms and Conditions are governed by Polish law. However, this does not deprive consumers of the protection afforded by mandatory provisions of the law applicable in their country of habitual residence.

  105. For matters relating to the App, the Service Provider may be contacted using the following details:

    • Robert Kostrzewa, KOSTRZEWADESIGN.COM

    • Address: ul. Stefana Okrzei 109, 55-080 Kąty Wrocławskie, Poland
